Emerald Coast Swimsuit Calendar Contest
All federal, state, local and municipal laws and regulations apply.
Void where prohibited.
1. Eligibility. Subject to the additional restrictions below,
the Emerald Coast Swimsuit Calendar Contest is open to U.S.
residents, male or female, who are 18 years or older at the time of
entry. Employees of the Northwest Florida Daily News Newspaper in
Education program, the Northwest Florida Daily News, Freedom
Communications and each of their respective affiliated companies, The
Palms, radio station Coast 93.3, Showbiz Tan, radio station Z96,
Avantgarde, Club Sun, Brava, Dolphin Cruises, American Laser, Showbiz
Tan, Royal Palms/Silver Shells Spa, The Palms Restaurant, Snap
Fitness, Fluid Surf Shop, Dolphin Cruise, or advertising and
promotional agencies, and the immediate family members of, and any
persons domiciled with, any such employees, are not eligible to enter
or to win.
2. Contest Period. The contest will begin at noon (C.S.T) on
June 15, 2009, and ends at noon (C.S.T) on Aug. 10, 2009.
3. Entry Proviso: Photographs must be submitted by the
entrant. No third-party entries will be accepted. Photos may not be
copyrighted unless the submittor has permission from the copyright
holder to submit the photo to the contest. Photos must have been
taken in the past three months. Entrants must look like the person in
the photo.
4. How to Enter Hardcopy Photographs: Beginning at noon
(C.S.T) on June 15, 2009, and ending at noon (C.S.T.) on July 10, 2009
(the “Entry Period for Hardcopy Photographs”), enter by
submitting a recent photo (within three months) of yourself
with all required information and a completed entry form. Entrants
are not required to live in Northwest Florida but winners must pick
up prizes in person, show personal ID, and be available for a photo
shoot on either Saturday, August 15; Wednesday, August 19; Saturday,
August 22; or Wednesday, August 26. Prizes cannot be shipped or
transferred to a third party. The Northwest Florida Daily
News Newspaper in Education program reserves the right to verify
proof of age. Only one photo per person per entry. Hardcopy photos
must be at least 3 inches on one side and no more than 10 inches, and
include the person’s name, address, e-mail address and
telephone numbers on a label on the back of the photo. Poor quality
photos will not be accepted. All photos become the property of the
Northwest Florida Daily News and will not be returned. Copyrighted
photos must be accompanied by permission from the copyright-holder to
use the photo in the contest. The submission constitutes the person’s
consent to the publication of their name and photo in any media for
any commercial or promotional purpose, without limitation, or further
compensation.
In-Person Entry. To enter in person, complete an Official
Entry Form available at The Northwest Florida Daily News office
located at 200 Racetrack Road, Fort Walton Beach, Fla., 32547. The
entry form with the photo can be dropped off in the lobby of The
Northwest Florida Daily News, Monday-Friday between 9 a.m. and 5 p.m.
(C.S.T.) In-person entries must be received by noon (C.S.T.) July 10,
2009. Photocopies of the entry form are permitted. Only one picture
per entry. All entries and pictures become property of the Northwest
Florida Daily News and none will be returned. Any questions regarding
the number of entries or votes submitted or the owner of an ISP
account shall be determined by Northwest Florida Daily News in its
sole discretion, and Northwest Florida Daily News reserves the
right to disqualify any entries or votes by persons determined to be
tampering with or abusing any aspect of the contest. In the
event of a dispute, all online entries and/or votes will be deemed to
have been submitted by the owner of the ISP account from which they
were sent. For these purposes, an ISP account holder shall mean the
natural person assigned to such ISP account by the Internet access
provider, online service provider or other organization responsible
for assigning ISP addresses for the domain associated with such ISP
account.
How to Enter Digital Photographs: Beginning at noon (C.S.T) on
June 15, 2009, and ending at noon (C.S.T.) on July 10, 2009 (the
“Entry Period for Digital Photographs”), enter by
uploading a recent photo (within three months) of yourself with all
required information and a completed entry form at the Northwest
Florida Daily News’ Web site (details to follow). Entrants
are not required to live in Northwest Florida but winners must pick
up prizes in person, show personal ID, and be available for a photo
shoot on either Saturday, August 15; Wednesday, August 19; Saturday,
August 22; or Wednesday, August 26. Prizes cannot be shipped or
transferred to a third party. The Northwest Florida Daily
News Newspaper in Education program reserves the right to verify
proof of age. Only one photo per person per entry. Digital photos
must also be at least 3 inches wide and have a resolution of at least
300 dpi. Most digital pictures taken in the mid-to-high quality photo
setting will be acceptable. Poor quality photos will not be accepted.
All photos become the property of the Northwest Florida Daily News.
Copyrighted photos must be accompanied by permission from the
copyright-holder to use the photo in the contest. The submission
constitutes the person’s consent to the publication of their
name and photo in any media for any commercial or promotional
purpose, without limitation, or further compensation.
Enter online by visiting the Emerald Coast Swimsuit Calendar Contest
official registration page on the Northwest Florida Daily News Web
site (www.nwfdailynews.com) and completing all of the required
information and following all posted instructions. Your computer must
accept cookies, or any successor or similar technology, which may be
used for the purpose of entry tracking. Complete the entry form,
upload a photo and any other required fields and then submit your
entry. Online submissions must be received by noon (C.S.T.) July 10,
2009. By entering, you agree to the terms of these Official Rules.
Standards and Proprietaries: The Northwest Florida Daily News
will exercise its right to decline photographs for reasons that
include but are not limited to: photographs of persons under the age
of 18; poor quality photographs; photographs that are too small;
photographs submitted by somebody other than the person in the
photograph; photographs the Northwest Florida Daily News considers to
be of questionable taste; photos that are so outdated the person no
longer resembles the person in the photo.
Voting Procedures and Rules. Voting for your favorite swimsuit
entrant Round 1 begins at 4 p.m. (C.S.T) on July 10, 2009, and
ends at noon (C.S.T) on July 24, 2009 (the “Voting
Period”). The field will be narrowed from all entrants to the
50 receiving the most votes in each of the male and female
categories. Voting for your favorite swimsuit entrant Round 2 begins
at 4 p.m. (C.S.T) on July 24, 2009, and ends at noon (C.S.T)
on Aug. 10, 2009 (the “Voting Period”). The top
vote-getter in each of the male and female categories will be
declared the winner; the 11 closest-finishers will be declared First
Prize winners.
You can vote for your favorite swimsuit photo online at
nwfdailynews.com. Votes cost $1 apiece in both rounds
with funds going to the Northwest Florida Daily News Newspaper in
Education program. Your computer must accept cookies, or any
successor or similar technology, which may be used for the purpose of
entry tracking. Ad blocking software on your computer needs to be
disabled so that it doesn’t interfere with processing your
entry. Northwest Florida Daily News will not be responsible for
failure to receive votes due to transmission failures or technical
failures of any kind, including, without limitation, malfunctioning
of any network, hardware or software, whether originating with sender
or Northwest Florida Daily News. In the event of a dispute, all
online entries will be deemed to have been submitted by the owner of
the ISP account from which they were sent. For these purposes, an ISP

6. Winner Selection. One (1) Grand Prize Winner and Eleven
(11) First Prize Winners will be determined by total votes only in
the male and female categories. The Grand Prize Winner will be the
entrant with the most votes and the eleven (11) entrants receiving
the next highest numbers of votes will be the First Prize Winners. In
the event of a tie, Northwest Florida Daily News will randomly pick
the winners from the tied entries. Winners will be selected on or
about Aug. 10, 2009.
7. Prizes.
Grand Prize: One (1) Grand Prize Winner in each category will
participate in a photo shoot conducted by a Northwest Florida Daily
News photographer on either Saturday, August 15; Wednesday,
August 19; Saturday, August 22; or Wednesday, August 26,
between the hours of 4:30 p.m. and sunset. Photographs from this
shoot will be used to illustrate the 2009 Emerald Coast Swimsuit
Calendar – one for women, the other for men - which the Daily
News will produce. The Grand Prize Winner in each category will have
their photos featured on the cover and on the month of their choice
in the calendar. They will receive an 8x10 color print of their photo
of choice, and have the option of purchasing others.
Ladies Grand Prizes: (1) Grand Prize Winner will receive
$1,500 toward any American Laser package; a weekend stay at The Palms
valued at $550; $50 credit to The Royal Palm/ Silver Shells Spa; a
$100 Avantgarde Spa gift; a one-month membership plus $100 to Club
Sun; a Brava gift basket valued at $100; A $25 Dolphin Cruise gift; a
$100 credit to Showbiz Tan; a $25 Gift Card to The Palms Restaurant;
a swimsuit valued at $75. Total value, $2,625.
Men’s Grand Prizes: (1) Grand Prize Winner will receive
$1,500 toward any American Laser package; a weekend stay at The Palms
valued at $550; $50 credit to The Royal Palm/ Silver Shells Spa; a
$100 Avantgarde Spa gift; a Snap Fitness gym membership plus $110; a
one-month membership plus $100 to Club Sun; a pair of boardshorts
from Fluid Surf Shop valued at $75; Dolphin Cruise valued at $25; a
$100 credit to Showbiz Tan; a $25 Gift Card to The Palms Restaurant.
Total value, $2,710.
Other prizes may be added at the discretion of the Northwest Florida
Daily News and its Newspaper in Education program.
First Prizes: Each of eleven (11) First Prize Winners in each
category will participate in a photo shoot conducted by a Northwest
Florida Daily News photographer on either Saturday, August 15;
Wednesday, August 19; Saturday, August 22; or Wednesday, August 26
between the hours of 4:30 p.m. and sunset. Photographs from this

Men’s First Prizes: Eleven (11) First Prize Winners will

8. Winner Notification and Acceptance. Winners will be
notified on or about Aug. 10, 2009 at the telephone number
provided on winner’s entry form. Northwest Florida Daily News
will call during regular business hours at the phone number provided
on then entry form and will leave no messages. Failure to reach
winner by phone may result in disqualification of winner, forfeiture
of her interest in all prizes, and selection of a substitute winner
from among all remaining eligible entries. To claim a prize,
the Grand Prize and First Prize winners must visit The Northwest
Florida Daily News office at 200 Racetrack Road, Fort Walton Beach,
Fla., during the weeks of Aug. 10-14, 2009 to pick up their prizes. A
valid photo identification of the entrant will be required. Prizes
are non-assignable and nontransferable. No substitutions allowed by
winner. Photo shoots in which all winners are photographed will be
scheduled for either Saturday, August 15; Wednesday, August 19;
Saturday, August 22; or Wednesday, August 26. Winners must
agree to be available for one of these photo shoots. Failure to
comply will result in forfeiture of prizes and their place in the
calendar. Winners will be required to sign an agreement to the date
and location of the photo shoot. Prizes and individual components of
prize packages are subject to availability and Northwest Florida
Daily News reserves the right to substitute prizes of equal or
greater value. Winners are solely responsible for reporting and
payment of any taxes on prizes. Winners may be required to complete
an affidavit of eligibility/liability and publicity release (except
where prohibited by law) which must be returned within the time
designated by the Northwest Florida Daily News Newspaper in Education
program. Failure to sign and return the affidavit or release or to
comply with any term or condition of these Official Rules may result
in a winner’s disqualification, the forfeiture of their
interest in the prize, and the award of the prize to a substitute
winner. Except where prohibited, acceptance of any prize constitutes
winner’s consent to the publication of their name, biographical
information and likeness in any media for any commercial or
promotional purpose, without limitation the Internet, or further
compensation. Prizes not won and claimed by eligible winners in
accordance with these Official Rules will not be awarded and will
remain the property of Northwest Florida Daily News.
9. Participation. By participating, entrants and voters agree
to be bound by these Official Rules and the decisions of Northwest
Florida Daily News. Northwest Florida Daily News reserves the right
to disqualify persons found tampering with or otherwise abusing any
aspect of this Contest as solely determined by Northwest Florida
Daily News. In the event the Contest is compromised by a virus,
non-authorized human intervention, tampering or other causes beyond
the reasonable control of Northwest Florida Daily News which corrupts
or impairs the administration, security, fairness or proper operation
of the Contest, Northwest Florida Daily News reserves the right in
its sole discretion to suspend, modify or terminate the Contest.
Should the Contest be terminated prior to the stated expiration date,
Northwest Florida Daily News reserves the right to determine winner
based on the entries received before the termination date.
10. Construction. The invalidity or unenforceability of any
provision of these rules shall not affect the validity or
enforceability of any other provision. In the event that any such
provision is determined to be invalid or otherwise unenforceable,
these rules shall be construed in accordance with their terms as if
the invalid or unenforceable provision was not contained therein.
11. Northwest Florida Daily News. Emerald Coast Swimsuit
Calendar Contest is Northwest Florida Daily News Newspaper in
Education program, The Palms, radio station Coast 93.3, Showbiz Tan,
radio station Z96, Avantgarde, Club Sun, Brava, Dolphin Cruises,
American Laser, Showbiz Tan, Royal Palms/Silver Shells Spa, The Palms
Restaurant, Snap Fitness, Fluid Surf Shop, Dolphin Cruise. All
donations will go to the Northwest Florida Daily News Newspaper in
Education program, an educational outreach effort designed to promote
literacy and knowledge of current events. The decisions of Northwest
Florida Daily News regarding the selection of winners and all other
aspects of the Contest shall be final and binding in all respects.
Northwest Florida Daily News will not be responsible for
typographical, printing or other inadvertent errors in these Official
Rules or in other materials relating to the Contest.
